PENEGAKAN HUKUM TERHADAP PERNIAGAAN GAS ELPIJI 3 KG SUBSIDI TANPA IZIN USAHA NIAGA (Suatu Penelitian di Wilayah Hukum Polresta Banda Aceh)

Abstract
Gas merupakan elemen penting dalam pemenuhan kebutuhan dasar masyarakat, baik untuk industri maupun rumah tangga, terutama di negara-negara berkembang. Pasal 23 ayat (2) Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi mengatur bahwa perdagangan gas tanpa izin usaha niaga dapat dihukum pidana maksimal tiga tahun dan denda hingga Rp30 miliar. Namun, masih banyak pelanggaran di lapangan terkait perniagaan gas elpiji 3 kg tanpa izin. Penelitian ini menggunakan metode yuridis empiris dengan pengumpulan data melalui wawancara dan penelitian lapangan. Hasil penelitian menunjukkan bahwa faktor penyebab utama pelanggaran tersebut terbagi menjadi dua: internal dan eksternal. Faktor internal mencakup niat pelaku, kondisi ekonomi, moralitas, dan pendidikan. Faktor eksternal mencakup mudahnya akses terhadap LPG bersubsidi dan kurangnya pengawasan. Penegakan hukum dilakukan melalui razia dan partisipasi masyarakat, sementara upaya pencegahan meliputi tindakan preventif dan represif. Disarankan agar Pemerintah Daerah dan Dinas Perindustrian serta Perdagangan Kota Banda Aceh memperkuat sosialisasi dan pengawasan, serta lebih tegas dalam menindak pelanggaran yang terbukti terjadi. Langkah ini diharapkan dapat menjaga tertibnya penyaluran gas LPG 3 kg sesuai dengan prosedur dan aturan yang berlaku.
Gas is a crucial element in meeting the basic needs of society, both for industries and households, especially in developing countries. Article 23, paragraph (2) of Law Number 22 of 2001 on Oil and Natural Gas regulates that the trade of gas without a business license may be punished with a maximum imprisonment of three years and a fine of up to IDR 30 billion. However, many violations related to the trade of 3 kg LPG gas without a license still occur in the field. This study uses an empirical juridical method with data collection through interviews and field research. The results of the study indicate that the main causes of these violations are divided into two categories: internal and external factors. Internal factors include the intent of the perpetrators, economic conditions, morality, and education. External factors include easy access to subsidized LPG and lack of supervision. Law enforcement is carried out through raids and community participation, while preventive efforts include both preventive and repressive measures. It is recommended that the Regional Government and the Department of Industry and Trade of Banda Aceh City strengthen socialization and supervision, and be more assertive in sanctioning proven violations. This step is expected to ensure that the distribution of 3 kg LPG gas complies with established procedures and regulations
